Please read these Terms of Use ("Terms") carefully before using the Guidera mobile application ("App") developed by Mehmet Selim Çetin ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are located in the European Economic Area, you must be at least 16 years old. By using the App, you represent that you meet the applicable age requirement.
Guidera is an AI-powered walking tour and place discovery app. It uses artificial intelligence to generate descriptions of real-world places, provides curated and custom walking tours with optional audio narration, and displays your location on a map for navigation purposes. The App is designed for personal, non-commercial use.
You acknowledge and agree that:
AI-generated descriptions and tour narratives are for informational and entertainment purposes only. They are not a substitute for professional guidance, official tourism information, or verified historical sources. The AI may generate content that is inaccurate, incomplete, misleading, or entirely fabricated. We do not verify, endorse, or guarantee the accuracy of any AI-generated content. You should independently verify any information that is important to you.
The App provides walking directions and tour routes for informational purposes. The AI is not physically present at your location and cannot assess real-world conditions such as road closures, construction, traffic, hazardous terrain, weather, or any other safety risks. You must always use your own judgment when following any route or direction suggested by the App. Never follow directions that appear unsafe, lead to restricted areas, or require you to cross dangerous terrain. You are solely responsible for your own safety while using the App. We are not liable for any injury, loss, or damage resulting from following routes or directions provided by the App.
The free tier includes map exploration, AI-generated descriptions (subject to daily limits), Quick Facts, text-only access to curated tours, and the Arthur guide persona with Informative and Playful personalities. Free-tier users will see advertisements.
Premium features include unlimited AI descriptions, text-to-speech audio narration, Walkman mode with audio, custom tour creation, chat Q&A, all guide personas and personalities, and an ad-free experience.
Free-tier users receive a daily allowance of AI descriptions, which resets at midnight in your local timezone. Additional descriptions can be earned by watching rewarded video advertisements. Daily limits are subject to change at our discretion.
Guidera offers non-renewing subscription passes that grant access to premium features for a fixed duration: 3-Day Pass, Weekly Pass (7 days), and Monthly Pass (30 days). These passes do not auto-renew. Once a pass expires, you return to the free tier unless you purchase another pass.
If you purchase a pass while a previous pass is still active, the new duration is added to your remaining time.
All payments are processed by Apple through the App Store. We do not collect or store any payment information. Prices are displayed in your local currency and may vary by region. We reserve the right to change pricing at any time; price changes will not affect passes already purchased.
Refunds are handled by Apple in accordance with Apple's refund policy. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly.
You agree not to:
Use the App in any way that violates applicable laws or regulations. Attempt to reverse engineer, decompile, or disassemble the App. Use automated tools, bots, or scripts to interact with the App or its underlying APIs. Circumvent or attempt to circumvent daily usage limits, rate limiting, or other restrictions. Resell, redistribute, or commercially exploit AI-generated content from the App. Use the App to harass, abuse, or harm others. Interfere with the App's operation or the servers and networks used to make the App available.
We reserve the right to restrict or terminate access to the App for any user who violates these terms.
The App, including its design, code, graphics, sounds, and branding, is owned by Mehmet Selim Çetin and protected by applicable intellectual property laws. AI-generated descriptions and tour content are provided to you for personal, non-commercial use. You may share AI-generated descriptions for personal purposes (for example, sharing a tour highlight with a friend) but may not reproduce, republish, or commercially exploit such content.
Apple Maps data, map imagery, and direction information displayed in the App are the property of Apple Inc. and its licensors, and are subject to Apple's terms of use.
The App relies on third-party services for its core functionality, including Google Gemini (AI content generation), OpenAI (text-to-speech), Google AdMob (advertising), Google Firebase (anonymous analytics and crash reporting), Apple MapKit (maps and directions), and Apple StoreKit (in-app purchases). These services are provided by their respective operators and are subject to their own terms of service and privacy policies. We do not control these services and are not responsible for their availability, accuracy, or content. Features may become unavailable or change if third-party services are discontinued or modified.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components; that AI-generated content will be accurate, complete, reliable, or current; that location data, walking routes, or directions will be accurate or safe; or that the App will meet your specific requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Your use of or inability to use the App; any AI-generated content, including inaccurate or misleading information; any action taken based on directions, routes, or navigation provided by the App; unauthorized access to or alteration of your data; any interruption or cessation of the App or third-party services; or any other matter relating to the App.
In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits our liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We may also update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms. For material changes, we may provide additional notice within the App.
You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access to the App immediately, without prior notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the App ceases, but the sections of these Terms that by their nature should survive (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will remain in effect.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.
If you are a consumer within the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board, but we will consider participation on a case-by-case basis.
These Terms are between you and Mehmet Selim Çetin, not Apple. Apple has no obligation to furnish maintenance or support for the App. Apple is not responsible for any product warranties, claims, losses, or liabilities. Apple is not responsible for addressing any claims relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to legal or regulatory requirements, or claims arising under consumer protection or similar legislation. In the event of any third-party intellectual property claim, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim. You represent that you are not located in a country subject to a U.S. Government embargo. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App. They supersede any prior agreements or understandings.
